Terms of Service & User Agreement

Effective Date: February 24, 2026

PLEASE READ THESE TERMS OF SERVICE CAREFULLY. BY ACCESSING OUR WEBSITE OR ENGAGING OUR GATE REPAIR AND INSTALLATION SERVICES, YOU AGREE TO BE BOUND BY THESE LEGALLY BINDING TERMS AND CONDITIONS.

1. Acceptance of Terms

By interacting with the website txautogates.com (the "Site") or requesting technical services from TX AutoGates ("the Company"), you signify your agreement to these Terms of Service. These terms constitute a legally binding contract between the property owner or authorized manager ("the Client") and TX AutoGates, located at 1200 Smith St, Houston, TX 77002. If you do not agree to all of the terms and conditions of this agreement, you must immediately cease use of the Site and our services.

2. Scope of Technical Services

TX AutoGates specializes in the diagnostic repair, preventative maintenance, and custom installation of automated gate systems, including sliding operators, swing operators, barrier arms, and access control peripherals. Our services are available for residential, commercial, and industrial properties across the Greater Houston area and North Texas.

2.1 Service Estimates

All on-site estimates provided by our technicians are valid for a period of thirty (30) calendar days. Estimates are based on visible malfunctions and standard diagnostic procedures. Should additional underlying issues be discovered during the repair process (such as underground wiring failure or structural post instability), the Client will be notified of the revised cost before work proceeds.

3. Property Access and Safety Requirements

To perform gate services effectively, the Client must ensure that TX AutoGates technicians have unobstructed access to the gate, electrical panels, and any relevant access control points. It is the Client's responsibility to ensure that all pets are secured and that children are kept away from the work area during the testing of heavy-duty gate machinery.

Emergency Access: For properties with existing safety violations or entrapment risks (non-UL 325 compliant), TX AutoGates reserves the right to refuse service or require mandatory safety upgrades before performing mechanical repairs. We are committed to the safety of the Texas public and will not bypass safety sensors or disable protective loops.

4. Payment Terms and Financial Obligations

Payment for services rendered is due immediately upon the completion of the work, unless otherwise specified in a corporate service contract. We accept major credit cards (Visa, MasterCard, Amex), verified bank transfers, and local business checks.

5. Warranty and Limitation of Liability

5.1 Labor Warranty

TX AutoGates provides a 90-day limited warranty on all repair labor. This warranty covers the specific adjustment or repair performed during the service call. It does not cover new, unrelated failures of other components within the gate system.

5.2 Parts Warranty

All new equipment installed (motors, motherboards, loops) is subject to the manufacturer’s warranty (e.g., LiftMaster, DoorKing). We will assist the Client in processing warranty claims, but the final determination of coverage is made by the manufacturer. No warranty is provided for "Client-provided" parts or used components.

5.3 Limitation of Liability

TX AutoGates shall not be held liable for indirect, incidental, or consequential damages, including loss of business, property damage caused by pre-existing structural decay, or gate failures resulting from "Acts of God" (lightning strikes, Texas floods, or hurricanes). Our total liability shall not exceed the amount paid for the specific service in question.

6. Compliance with UL 325 and ASTM F2200 Standards

The State of Texas observes strict safety standards for automated gates. TX AutoGates operates in full compliance with Underwriters Laboratories (UL) 325 and ASTM F2200. We will not perform any repair that results in a gate system lacking proper entrapment protection (photo-eyes or safety edges). If a Client refuses to install required safety devices, TX AutoGates may terminate the service agreement immediately to prevent legal liability and public risk.

7. Intellectual Property and Digital Use

All content on txautogates.com, including text, custom graphics, logos, and technical descriptions, is the exclusive property of TX AutoGates. Unauthorized "scraping" or duplication of our content for use on competing "gate repair" websites is strictly prohibited and will be met with legal action under the DMCA and Texas business codes.

8. Dispute Resolution and Governing Law

Any dispute arising from these Terms of Service or our technical work shall first be attempted to be resolved through good-faith negotiation. If a resolution cannot be reached, the dispute shall be settled by binding arbitration in Harris County, Texas. These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

9. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. These Terms constitute the entire agreement between TX AutoGates and the Client regarding the use of the Site and the provision of services.
